Landlord and tenant

Our landlord and tenant disputes practice includes:

  • Commercial lease renewal
  • Possession and arrears claims
  • Forfeiture claims
  • Commercial distress
  • Dilapidations claims
  • Right to manage claims

Commercial leases are often renewed rather than terminated and we can assist in ensuring that suitable notices are served and deadlines are met, and that any necessary court proceedings are issued promptly and correctly.

Recovering possession or arrears of rent for commercial or residential premises requires a detailed knowledge of law and procedure.  We apply this knowledge to achieve a swift and cost-effective result for our landlord clients.  This might involve forfeiture through instructing a bailiff, removing goods to cover outstanding rent ('distress') or issuing proceedings in court.

We are also involved in claims for repairs on the termination of leases and in particular claims under the dilapidations protocol.

We can advise on the potentially complicated procedure where a right to take over the management of a leasehold property arises.  It is important to ensure that this procedure is closely followed in order to enforce the right to manage.

Our specialists in these areas are Richard Gore and Ken McEwan.
