Conservative victory: What lies ahead for employment law?

Following the Conservative Party’s success, Nick Jones and Cecily Donoghue, solicitors in Gregg Latchams’ Employment and Business Support team revisit the Tory election manifesto and the key employment law pledges upon which we can expect forthcoming developments in the new parliament:

  • A review to explore how the self-employed can be better supported. This will look at improving access to finance and credit, making the tax system easier to navigate and also looking at how broadband can improve home-working.  Also a review on the introduction of IR35 into the private sector. 
  • A consultation on making flexible working the default position unless employers have good reason not to allow it.
  • Introduction of legislation to allow parents to take extended leave for neonatal care and also to consider ways to make it easier for fathers to take paternity leave.
  • A proposal to widen the scope of the National Living Wage so that it is available to those aged 21+ (currently 25+).
  • Introduction of a single employment enforcement body to provide greater protection of employment rights and to crack down on employers who abuse employment law.
  • Extending an entitlement to leave for unpaid carers, who are mostly women, to one week.
  • Making change to existing redundancy law to prevent employers from discriminating against women immediately after returning from maternity leave.
