Resolving disputes.... An update

The Gregg Latchams’ Dispute Resolution team has been anything but quiet recently. It has been adding to the services it is able to offer to its clients, to referrers and to third parties faced with disputes.

Arbitrators

Especially relevant to disputes, team members, Ken McEwan and Emma Ironside have successfully completed the first stage of their CiArb training. They are now able to act as arbitrators in any disputes where the parties are bound by an arbitration clause or wish to refer a dispute to arbitration.

Arbitration is being used as a means of resolving commercial disputes much more now as the cost of going to court becomes prohibitive. Our team’s expertise and training allows them to continue representing clients through the whole arbitration process, as well as being able to now take on further work in carrying out the arbitrations themselves.

Mediator

Richard Gore has qualified as an accredited commercial mediator. Alongside arbitration, mediation is taking a more prominent role in resolving disputes due to  the courts themselves encouraging parties to adopt the process at an early stage of proceedings, if it has not been attempted before.

Richard is available to sit as a mediator in a range of commercial disputes. Alongside that he continues to represent clients in their own disputes. 

He has established a reputation that is recognised in the leading legal directory, Chambers & Partners as a notable practitioner for the past 3 years.

Case updates

The team has also continued to represent its clients in a range of different issues and disputes, including:

  • Emma Ironside acted for a client who was served with a statutory demand for debts owed by the tenants of his flat and not him personally. As a result, there were significant amounts owed and the client faced being made bankrupt as a result of debts that were not his. Emma applied successfully to the court to get the statutory demand set aside and an order that the money was not owed by the client 
  • Lucy Mills is acting for a client who was given bad tax advice by a firm of accountants, which resulted in him suffering a significant loss. The case went to mediation over the summer. Whilst no settlement was achieved, as a result of the mediation, the issues have been narrowed and it may well be that the case will still settle before trial.

Finally, the Dispute Resolution team also offers a number of fixed fee products including:

  • Company restoration
  • Personal guarantee advice
  • Contract review
  • Debt collection
